In May 2016, partner Vincent A. Nagler represented a building owner in Kings County accused of not properly maintaining cellar doors on a city public sidewalk. Despite the plaintiff’s expert’s testimony that the cellar door variances constituted a building code violation, the jury found no liability on behalf of the building owner.
In June 2016 Mr. Nagler defended a cardiologist accused of malpractice in a wrongful death action venued in Kings County. Plaintiff claimed the cardiologist did not diagnose a mitral valve regurgitation resulting in a sudden cardiac arrest. Mr. Nagler challenged the plaintiff’s theory of the case. The jury returned a verdict in favor of the cardiologist.
In July 2016, Mr. Nagler represented a contractor in Bronx County on a claim that he negligently installed a towel dispenser that subsequently became dislodged and fell on a cleaning contractor’s employee. The plaintiff underwent a cervical discectomy and fusion and claimed he was wheel chair bound as a result of the accident. After a four week trial, the Bronx jury returned a verdict in favor of Mr. Nagler’s client.
