Barry Morgenstern, MD & Medical Arts Radiology Group, PC, the plaintiff claimed that the defendants failed to properly interpret a mammogram, causing a delay in a diagnosis of breast cancer. A Suffolk County jury returned a verdict in favor of the defendants.
A Bronx County jury returned a defense verdict in the case of Leonard Guardino v. Albert Graziosa, MD. There, the plaintiff claimed that the defendant improperly reduced an ankle fracture with closed reduction rather than open reduction and internal fixation. The plaintiff claimed a malunion of the ankle fracture and permanent disability. The trial lasted 2 weeks before the jury ruled in favor of the defense.
In Harvey Yancey v. Yong H. Kim, MD, a surgeon was alleged to have failed to properly perform a discectomy, laminectomy and spinal fusion at three levels and implantation of stabilizing rods and pedicle screws on the plaintiff resulting in sacral fracture and permanent pain and disability. A Bronx County jury disagreed with this claim and rendered a defense verdict in favor of the surgeon.
