On November 16, 2021, a New York County jury returned a verdict in favor of KBN’s client, a plastic surgeon, who was accused of malpractice stemming from a May 30, 2014 surgery to repair fractured bones, severed nerves, and lacerated tendons in a then 36-year-old male’s left hand. KBN partner Louis E. Valvo successfully defended the surgeon and presented evidence that the surgeon conducted the procedure and the follow-up treatment professionally and within the standards of care. The plaintiff presented an expert in the field of orthopedic surgery. However, under cross-examination by Mr. Valvo, the plaintiff’s expert conceded that KBN’s client did provide sufficient information to allow for informed consent and further demonstrated that the surgery performed by the plastic surgeon was accepted in the field. After a two-week trial, the jury returned a verdict in favor of KBN’s client.
